Celebetie Creator Terms of Service

Welcome to Celebetie! These Creator Terms of Service ("Creator Terms") govern your use of the Celebetie platform (the "Site") as a creator, celebrity, influencer, or performer (collectively, "Creator", "you", or "your").

By registering as a Creator on Celebetie, you agree to be bound by these Creator Terms, as well as our general Site Terms of Service and Privacy Policy. If you do not agree, do not use Celebetie as a Creator.

1. Account Registration and Eligibility

  • Eligibility: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to register as a Creator on Celebetie.
  • Accuracy: You agree to provide true, accurate, and complete information during registration. You must not impersonate any person or entity.
  • Security: You are responsible for maintaining the security of your account and password. Celebetie is not liable for any unauthorized access to your account.

2. Celebetie Requests and Fulfillment

  • Receiving Requests: Users may request personalized videos or other digital offerings ("Celebetie Videos") from you through the Site.
  • Acceptance and Rejection: You have absolute discretion to accept or decline any request. You are never obligated to create a video you do not want to make.
  • Fulfillment Timeframe: You agree to fulfill accepted requests within [7 days] of receiving them. If a request is not fulfilled within this timeframe, it will expire, and the user will not be charged (or will be fully refunded).
  • Creative Control: You have sole creative control over the content of your Celebetie Videos, provided you comply with the user's general instructions and our Acceptable Use Policy.

3. Licensing and Ownership

  • Your Ownership: You retain all ownership rights to the original content you create on Celebetie.
  • License to Celebetie: By uploading a Celebetie Video, you grant Celebetie a non-exclusive, royalty-free, fully paid, worldwide, sublicensable, and transferable license to use, reproduce, distribute, publicly display, and promote your videos on the Site and across our marketing channels.
  • License to Users (Personal Use): When you fulfill a standard request, you grant the requesting user a non-exclusive, royalty-free, worldwide license to use, reproduce, and display the video for their personal, non-commercial, and non-promotional purposes.
  • License to Users (Business Use): If you opt-in to offer "Business Celebeties," you grant the purchasing business a limited license to use the video for promotional purposes as specified in the request, typically for a limited time (e.g., 30 or 90 days) and in specific channels.

4. Fees and Payments

  • Setting Your Price: You set your own booking price for your Celebetie Videos through your Creator dashboard. You may change your price at any time, but price changes will not affect pending requests.
  • Revenue Share: For each completed Celebetie Video, you will receive 70% of the total price paid by the user, and Celebetie will retain 30% as a platform fee.
  • Payment Processing: Payments are processed via our third-party payment provider, [Stripe/PayPal]. You must create and link an account with our payment provider to receive payouts.
  • Payout Schedule: Payouts for completed videos will be transferred to your linked account on a [weekly/monthly] basis, subject to a minimum payout threshold of [$20.00].

5. Content Restrictions and Acceptable Use

You agree that your Celebetie Videos will not contain any content that:

  • Is defamatory, abusive, hateful, threatening, or harassing.
  • Contains sexually explicit material, nudity, or pornography.
  • Infringes on any third-party intellectual property rights (including playing copyrighted music in the background).
  • Promotes illegal acts, gambling, or regulated substances.
  • Violates any applicable laws, rules, or regulations.

Celebetie reserves the right to remove any content or suspend any account that violates these rules at our sole discretion.

6. Representations and Warranties

By submitting any Celebetie Video, you represent and warrant that:

  • You are the individual depicted in the video.
  • You own or possess all necessary rights, licenses, and permissions to grant the licenses described in these Creator Terms.
  • The creation and distribution of the video does not violate the rights of any third party (including privacy, publicity, and intellectual property rights).

7. Independent Contractor Status

Nothing in these Creator Terms creates an employment, agency, partnership, or joint venture relationship between you and Celebetie. You are strictly an independent contractor. You are solely responsible for declaring and paying any applicable local, state, or federal taxes on your earnings from Celebetie.

8. Termination

  • By You: You may terminate your Creator account at any time by unpublishing your profile and notifying us at support@celebetie.com. You must complete or cancel any pending requests before termination.
  • By Celebetie: We may suspend or terminate your account at any time, with or without cause, including for any violation of these Creator Terms. Upon termination, we will pay out any final balance owed to you for completed videos.

9. Limitation of Liability and Indemnification

  • Indemnification: You agree to indemnify, defend, and hold harmless Celebetie, its affiliates, and its employees from any claims, damages, obligations, or liabilities arising from your Celebetie Videos, your use of the Site, or your violation of these Creator Terms.
  • Limitation of Liability: To the fullest extent permitted by law, Celebetie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform.

  • Transaction & Payment Information: If you purchase a Celebetie Video, our third-party payment processors (e.g., Stripe, PayPal) collect your billing details. We do not store your full credit card number. For Creators, we collect payout information, such as banking details and necessary tax forms.
  • User Content: We collect the information you include in your requests (prompts, recipient names, instructions) and the Celebetie Videos created and uploaded by Creators.
  • Communications: When you contact us at support@celebetie.com or communicate with other users on the platform, we collect the contents of those communications.

B. Information We Collect Automatically

  • Device and Usage Data: We automatically collect data about your device and how you interact with the Site, including your IP address, browser type, operating system, pages visited, links clicked, and the dates and times of your visits.
  • Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to track activity on our Site, remember your preferences, and improve user experience.

2. How We Use Your Information

We use the Personal Information we collect for the following purposes:

  • To Provide Our Services: Facilitating requests, processing payments, delivering Celebetie Videos, and managing User and Creator accounts.
  • To Improve Our Platform: Analyzing usage trends to enhance the features, functionality, and security of the Site.
  • For Communication: Sending you transactional emails (receipts, booking updates, Creator payout notifications) and responding to your customer support inquiries.

We do not sell your Personal Information. We may share your information in the following circumstances:

  • Between Users and Creators: To fulfill a request, we share the User's provided instructions, recipient name, and booking details with the Creator. We do not share the User's payment information or private email with the Creator.
  • Publicly on the Platform: Celebetie Videos, Creator profiles, and User reviews may be publicly visible on the Site unless designated as private during the booking process.
  • With Service Providers: We share data with trusted third-party vendors who perform services on our behalf, such as payment processing, data hosting (cloud services), email delivery, and analytics.
  • Business Transfers: If Celebetie is involved in a merger, acquisition, or sale of all or a portion of its assets, your information may be transferred as part of that transaction.
  • Legal Requirements: We may disclose your information if required to do so by law, or in the good faith belief that such action is necessary to comply with legal processes, protect our rights or property, or ensure the safety of our users or the public.
